The Incapacity Crisis: A Nation Unprepared

The Incapacity Crisis: A Nation Unprepared

This July is the launch of the Solicitors For the Elderly campaign: Choice Not Chance, raising awareness of the importance of Health and Welfare Lasting Powers of Attorney (“LPAs”).

A Health and Welfare LPA is an important legal document giving someone you trust, your Attorney, the legal authority to make decisions on your behalf in respect of your health and welfare if you lose mental capacity at some point in the future. It also allows you to express your wishes regarding end of life medical care and treatment.

Solicitors for the Elderly have revealed that a staggering 65% of people believe that their next of kin can specify what they would have wanted if they are no longer able to. This is incorrect – a stranger such as a Doctor will make best interest decisions in the absence of a Health and Welfare Lasting Power of Attorney.

Every 3 minutes somebody in the UK develops dementia, yet only around 3% of people have a Health & Welfare LPA in place. Do your loved ones know how you would like to be cared for in later life? Don’t leave them in the dark, start the conversation now.

To make sure your Health and Welfare LPA is robust and covers all the things you need it to, seek expert advice from one of our Solicitors for the Elderly accredited Solicitors.
